Two Lusaka residents sue govt, demand K2 million each for wrong imprisonment

Two Lusaka residents have sued the Attorney General, demanding K2 million each from the department of Immigration as compensation for false imprisonment.

The first litigant, Muyambango Muyambango, is also claiming K17,300 and a phone, which were confiscated by the Immigration during the alleged unlawful arrest while the second plaintiff, Alfred Zalimba, demanding damages for deprivation of use of his motor vehicle.

The duo want interest on the sums paid as due.

In a statement of claim filed in the Lusaka High Court on Friday, Muyambango and Zalimba stated that on November 11, 2022, the plaintiffs were apprehended by the department of immigration through its officers namely Shadreck Mwamba, Ian Mutamina, Jimmy Kapanda and Anthony Mwala.

They said the arrest was based on an unsubstantiated charge and were detained at Ridgway police post for six days.

“At the time of the arrest, the said officers confiscated the first plaintiffs phone names one plus 11 phone and the cash sum of k17,300.00.The said officers also impounded the second plaintiffs motor vehicle known as Toyota Wish registration Mark ALG 6614,” plaintiffs stated.

However, after their release, the Immigration could not account for the confiscated items .

“The first plaintiff has to replace the monies grabbed from him as well as his lost phone, similarly, the second plaintiff was made to be without his asset the motor vehicle for three months which is a great financial loss as he uses the said motor vehicle for cab hailing services,” they said.

The said vehicle was impounded for an extended period of three months after the plaintiff’s release from custody.
