Solicitor-General drags ex-ACC board member, Kaaba, to court over alleged defamation of character

Solicitor-General, Marshal Muchende, has filed a defamation lawsuit against former Anti-Corruption Commission (ACC) board member and commissioner, O’Brien Kaaba.

The case, now before the Lusaka High Court, revolved around allegations that Muchende was involved in corrupt activities alongside ex-ACC Director-General Thom Shamakamba.

Muchende vehemently denied these accusations, asserting that he has had no contact with Shamakamba since an ACC investigation was launched against him for allegedly receiving a $500,000 bribe from a former provisional liquidator.

Shamakamba resigned from his position on Tuesday following the corruption revelations made by Kaaba.

In his statement of claim, Muchende insisted he had never facilitated corrupt deals or solicited litigants to sue the government in pre-arranged settlements.

He contends that Kaaba’s public remarks, published in the Daily Nation and Daily Revelation newspapers, have severely damaged his reputation both locally and internationally, portraying him as a key player in illicit dealings involving substantial sums of money.

Muchende is seeking damages for the libelous statements, arguing that they were made with reckless disregard for his duty to uphold the law.

He is also requesting an injunction to prevent Kaaba from making further defamatory remarks.

Despite demanding a retraction and apology from Kaaba, none have been forthcoming.

The Solicitor-General maintains that the allegations have caused him significant emotional distress and tarnished his reputation as a respected legal practitioner.
