Retired soldier claims impotence in defilement case, doctor testifies otherwise

A 76-year-old retired soldier from Chibolya Compound, Kanche Muloko, accused of defilement, has requested a test to prove his claim of impotence due to a landmine accident over 20 years ago.

Testifying before Lusaka Magistrate Mutinta Mwenya, Dr. Michael Mwamba from Kanyama Level One Hospital stated that Muloko’s penis was intact and that the screws mentioned by the accused were on his stomach.

Dr. Mwamba confirmed the defilement of the minor victim, who was found with cuts and white discharge on her private part.

The victim tested negative for HIV, syphilis, hepatitis B, and pregnancy.

The doctor concluded that the injury to the hymen was caused by penetration.

During cross-examination, Muloko asked if the white discharge could be proven to come from him, to which the doctor replied it could not be determined.

The accused also requested to be tested for erection, but the doctor explained that an erection is a mental response and cannot be tested.

The state closed its case and the trial was adjourned to July 17, as the victim’s mother has been unavailable to testify, with reports suggesting her reluctance to appear in court.
