PF faction president, Miles Sampa, has countersued Morgan Ng’ona, seeking an injunction to stop him and Robert Chabinga from masquerading as the party’s Secretary General and President, respectively.
Ng’ona had previously taken the matter to the Lusaka High Court, seeking a declaration that Sampa’s decisions were illegal and null, arguing that Sampa exceeded his powers and violated the party constitution by making changes without central committee ratification.
Mg’ona sought a stay on Sampa’s decisions, accusing him of undermining intra-party democracy and infringing on members’ rights.
The Lusaka High Court granted the stay.
Sampa, who is also the Matero Member of Parliament, contended in his counterclaim and defense that the party constitution granted him the authority to take actions he believed were in the best interest of the party’s development or security.
He told the Lusaka High Court that he did not require the central committee’s ratification to dismiss Ng’ona and Chabinga from their positions.

Sampa seeks a court order affirming Ng’ona’s removal from his positions and declaring his own expulsion from the party null and void.
He argued that the pronouncements made by Ng’ona and Chabinga at a July 3 press briefing, claiming he had been expelled, were contrary to the PF party constitution.
Additionally, Sampa seeks a declaration from the court that Ng’ona and others lacked the legal capacity to convene a central committee meeting in the absence of both him and the national chairperson.
He wanted the court to declare null and void the reversal of his decision to remove Ng’ona and Chabinga from their respective positions.
