Nakacinda asks court to commit PerSec, Matembo, to prison for allegedly interfering with processes

Patriotic Front (PF) Secretary General, Raphael Nakacinda, has asked for permission of the High Court to institute contempt of Court proceedings against Ministry of Home Affairs and Internal Security Permanent Secretary (PS), Dickson Matembo, for allegedly interfering with a witness, former Registrar of Societies, Thandiwe Mhende.

Nakacinda alleged Matembo intentionally and willfully, with plans to prejudice, disrespect and disturb the proceedings before High Court Judge, Timothy Katanekwa, by intimidating the Registrar of Societies, then Mhende, an action which undermined the proceedings.

This was according to a statement in support of application for committal proceedings filed in a matter in which Matero Member of Parliament, Miles Sampa, was challenging his suspension from the party.

He was suspended from the party for alleged gross misconduct.

Sampa commenced the matter in February this year and cited PF vice president, Given Lubinda and Nickson Chilangwa (then acting Secretary-General) as defendants.

Nakacinda has submitted that the PS intimidated Mhende, who was summoned to testify in the matter.

He stated that interfering with witnesses amounts to contempt of court.

“The alleged contemnor deliberately, intentionally and wilfully with intention to prejudice, disrespect and disturb the proceedings before Judge Katanekwa by intimidating the Registrar of Societies then Mrs Thandiwe Phiri-Mhende, an act meant to undermine the court and the proceedings of this court,” he said.

Nakacinda wants the court to send the PS to prison for interfering with a witness, thus, undermining the proceedings of the court.

And, further for the court to order the alleged contemnor to pay costs incidental to the application.
