Former Lusaka Province Minister. Bowman Lusambo, is facing legal trouble after Isoka Member of Parliament Marjorie Nakaponda petitioned the Lusaka High Court to enter a default judgment against him in a K375,000 dispute.
Nakaponda is seeking a refund from Lusambo, accusing him of failing to defend himself in the case.
She argued that he had neither filed a memorandum of appearance nor a defense within the required legal timeframe.
Citing Order 12, Rule 1 of the High Court Rules, Cap 27 of the Laws of Zambia, Nakaponda has requested a default judgment, which, if granted, would compel Lusambo to repay the K375,000 she had paid under an agreement to purchase his Silverest house in Chongwe, Lusaka.
The court would also assess damages for breach of contract.
The dispute stems from a failed sale agreement signed on April 28, 2024, for a house priced at K600,000.
Nakaponda made payments totaling K375,000, but when she contacted Lusambo on June 5, 2024, to finalise the balance, he ceased all communication.
Despite issuing a demand letter on October 14, 2024, requesting a refund, Nakaponda said Lusambo ignored her plea and failed to reimburse the amount.
She claimed his actions have caused her financial loss and emotional distress, leading her to seek legal redress.
