Lusaka woman seeks damages after alleged wrongful detention while pregnant

Idah Banda, a resident of Chilenje South in Lusaka, has sued the State, seeking damages for alleged wrongful detention while seven months pregnant.

Banda named the Attorney-General and prosecuting officer, Caleb Zulu, of Northmead Police Station as defendants, seeking compensation for wrongful imprisonment, pain, suffering, and other damages.

The lawsuit stated that on May 29, 2023, around 17:00 hrs, Officer Zulu arrested Banda on suspicion of forgery and document falsification.

Banda, who was seven months pregnant at the time, was detained at Northmead Police Station and charged with the offence.

According to the suit, Banda was held without reasonable or probable cause.

During her detention, she was allegedly kept in a cell contaminated with human waste, causing severe discomfort and health issues.

Banda was released on May 30, 2023, after approximately 24 hours in custody, when Officer Zulu reportedly informed her that she had been wrongfully detained.

She claimed the detention resulted in physical and emotional distress, including muscle sprains, headaches, respiratory issues, and psychological impacts such as anxiety, fear, and humiliation.

The National Legal Aid Clinic for Women filed the lawsuit on Banda’s behalf, seeking damages for wrongful imprisonment, pain, and suffering.
