Lusaka businessman sues Attorney-General, demands K17 million over alleged miscarriage of justice

A resident of Lusaka’s Mandevu compound has filed a K17 million worth lawsuit against the Attorney-General, as damages for false imprisonment and contraction of HIV while in custody.

Gerald Sinkamba, also a businessman, said in a statement of claim filed at the Lusaka High Court, that he was arrested on February 2 ,2022, on charges of aggravated robbery and was in detention till July 13, 2023, when he was acquitted by the court.

He claimed that it was during the period of detention that he contracted numerous diseases, among them, Tuberculosis, HIV and Anemia and was admitted at University Teaching Hospital.

He further alleged that on the date he was arrested, Police officers based at Lusaka Central Police Station mercilessly tortured him, which resulted in him sustaining multiple injuries.

Sinkamba claimed to have suffered lacerations to the forehead, lips, a swollen and painful head, inflamed and painful eyes and temporal loss of hearing.

He said despite the court’s order for him to get medical attention, the police officers refused leaving the plaintiff in constant physical and mental anguish.

“The plaintiff remained in custody for a period of more than 17 months before his acquittal and during his incarceration, he contracted numerous diseases and conditions including TB, HIV and Anemia which led to his admission at UTH” he said.

Sinkamba wants the court to pay him a total sum of K17 million as damages for loss of amenities of life as a result of his current health, wrongful detention, malicious prosecution and physical injury, pain, suffering and mental anguish.
