Lusaka businessman, Findlay, to defend charge of owning more than one passport

Lusaka businessman, Valden Findlay, has been placed on his defense in a matter where he pleaded not guilty to the charge of holding more than one passport.

Lusaka Magistrate, Sylvia Munyinya, on Monday found Findlay with a case to answer, stating that the state prosecution had made its case.

Defense lawyer Milner Katolo informed the court that his client intended to call at least five witnesses.

Findlay is scheduled to open his defense on September 3, 2024.

Meanwhile, Findlay has been granted temporary release of his passport. This follows an application filed on July 11, 2024, for the temporary release of the passport.

Katolo submitted that the accused had an appointment on July 22, 2024, at the instance of the consultant attending to him, indicating that he had to undergo further investigations regarding his cardiac problem.

He submitted that the application was duly served on the state, and there was no opposition from the state.

Based on the established precedent where the accused had always returned to court and surrendered the passport each time a temporary release was granted, Katolo humbly beseeched the court to grant the application as prayed.

The State did not object to the application. Consequently, the court granted the application on the conditions attached to the first order of the temporary release of the passport.

It is alleged in count one that on March 14, 2014, in Lusaka, Findlay acquired a Zambian passport number ZP021382, purporting to have lost Zambian passport number ZP013259.

In count two, it is alleged that on October 3, 2022, in Lusaka, Findlay was found in possession of endorsements of forged immigration stamps for Mwami immigration border control.
