Legal battle over late Mwanawasa’s retirement house rages, as University of Lusaka seeks removal of caveat

The legal battle for late President Levy Mwanawasa retirement house has raged on, with University Of Lusaka Limited, who claim to be the rightful owner, seeking an order for the removal of the caveat placed on the property by the State.

University of Lusaka Limited (UNILUS), in its documents filed in the Lusaka High Court, submitted that it has been unable to have quiet enjoyment of the property known as Lot 24802/M, chongwe district in Lusaka Province, due to the caveat placed on it.

It has cited the Attorney General as a respondent.

In an affidavit in support of originating summons, UNILUS registrar, Kawanga Kapalayi, that the sale of the property to the learning institution was a private transaction and pre-consent of the President to assign the property was approved for and obtained as required by law.

Kapalayi said the property was bought from its previous owners, Esther Chipasi and Mustapha Kwabena Osuman on February 27,2023.

The duo had bought the property from the widow, Maureen Mwanawasa.

“That since 27th February,2023, the applicant has been the tenant or lessee of the property for the unexpired residue term of 99 years from 1st of May,2012,” he said.

Kapalayi stated that the transfer of ownership was surprised by the Attorney General’s Office and a certificate of title relating to the property no.144302 was issued by Ministry of Lands to UNILUS.

He said the applicant was shocked when the Attorney General placed a caveat on the house on April 28,2023.

Kapalayi further stated that despite writing a demand letter to the Attorney General on May 19,2023, the situation had remained the same as at May 30,2023.

Earlier, UNILUS in a separate matter sued the Attorney General and other unknown persons claiming possession of the house which it purchased at US$2,190,000.00.
