Kasanda returns to court to challenge alleged unlawful re-arrest after being discharged

Sedrick Kasanda has filed for a writ of habeas corpus in the Lusaka High Court, challenging his re-arrest last week, just an hour after being discharged on aggravated robbery charges.

Kasanda’s legal team submitted an ex parte notice of motion, demanding his immediate release from what they describe as unlawful detention.

Court documents reveal that Kasanda was first arrested in August 2023, accused of stealing $5 million from Egyptian national Michael Adel Botros in connection with the Kenneth Kaunda International Airport gold scandal.

His trial commenced in April 2024, but after the prosecution failed to present key Egyptian witnesses, the case was dismissed on August 20, 2024, through a nolle prosequi.

Despite this, Kasanda was re-arrested just hours later and has since been held without any formal charges or court appearance, with the State citing ongoing investigations as justification.

Kasanda contended that his detention was both unlawful and unconstitutional.
