‘I never requested for Musonda’s massage the first time,’ woman tells court

Mwansa Charity Njelesani has objected to the defence by Taj Pamodzi Hotel Plc claiming that she requested for Kenneth Musonda to massage her the first time she sought their spa services.

Njelesani contended that it was instead the Hotel that recommended Musonda to her.

This was in a matter she had sued the hotal and Musonda in the Lusaka High Court, accusing the latter of sexually assaulting her on May 24, 2024 by touching her private parts which included massaging her clitoris and even asking if he could ejaculate in her.

She alleged that during the session, Musonda started massaging erogenous zones and she immediately went into tonic immobility.

But the hotel countersued, claiming damages for deceit and interest on the amount found due.

Taj Pamodzi in its defence and counterclaim, admitted that Musonda was a masseur in its Jiva Spa but denied that he sexually assulted the litigant in May, 2022.

Njelesani in reply and defence to the hotel’s counterclaim insisted that she was sexually assulted by Musonda, the first defendant in the matter.

“The plaintiff denies requesting for the first defendant the first time she was introduced to the Spa as alleged by the second defendant as it was the second defendant who recommended the first defendant and reiterates the contents of the claim,” she argued.

She also denied telling the hotel management that Musonda had ejaculated on her.

Njelesani stated that she was never availed with a proper investigation report containing the summary of the facts,the analysis of the case, nor the findings of a disciplinary hearing.

She added she only received an email stating that Musonda was not guilty of sexual assualt.

The plaintiff submitted that the hotel management never communicated to her the appointment of a private investigator and she was uncomfortable to discuss sexual assualt with a stranger over a phone call.

Njelesani stated that the move to report the assualt to hotel management was not to ask for money but was to ensure that no other women went through what she had gone through at Spa in the hands of its employees such as Musonda.
