The State has opposed an application for bail pending appeal by former police deputy Inspector-General, Charity Katanga, jailed for three years for being in possession of property suspected to be proceeds of crime.
Katanga in her application for bail before Lusaka Chief Resident Magistrate Davies Chibwili contended that the appeal would be a success.
She submitted that the possession of Property reasonably suspected of being proceeds of crime contrary to section 71(1) of the Forfeiture of Proceeds of Crime Act No. 19 of 2010 of the Laws of Zambia was bailable.
The convict’s fear was that she would serve a substantial portion of the sentence by the time the appeal was heard.
But the State opposed the application that the Economic and Financial Crimes Court was a fast track Court, thus, Katanga’s appeal would not take long to be processed.
“Having endeavored to demonstrate that the applicant has not demonstrated any exceptional circumstances to warrant this honourable Court to grant her bail pending appeal, it all is our prayer that the application for bail pending appeal be dismissed,” the State submitted.
Magistrate Chibwili is scheduled to render ruling on the application.
On Monday the ex-deputy Inspector- General was jailed for the three years simple imprisonment for being in possession of 10 luxurious Higer buses through proceeds of crime.
