Ex-President Edgar Lungu’s barber, Shebby Chilekwa, contends that the High Judge, Charles Zulu, erred in law and fact when he convicted and sentenced him to 25 years imprisonment with hard labour based on unsubstantiated evidence.
On Thursday, Justice Zulu found Chilekwa guilty of the murder of United Party for National Development (UPND) cadre, Lawrence Banda and sentenced him to 25-years imprisonment with hard labour.
Facts are that in 2019, during the Council Chairperson’s by-elections held in Kaoma,Chilekwa shot dead Banda.
In February,2022,he was arrested and jointly charged with former Patriotic Front (PF) Deputy Secretary General Mumbi Phiri.
However, a nolle prosequi was entered against Phiri.
Chilekwa through his lawyers,Makebi Zulu and Advocates appealed against the conviction and sentence rising 13 grounds of appeal.
He contended that Justice Zulu erred in law and fact when he convicted him of murder in the absence of anyone identifying the body of the victim.
He stated that it was an error by the Judge to have concluded that the fire arm used at the scene was not recovered without any evidence to suggest such and disregarded the failure by the police to test the cartridges as against the firearm found on Chola Simwaba.
Chilekwa stated that the trial court failed to consider the testimony of the prosecution witnesses in cross examination that was favorable to him.
