Ex-DG of water resources authority, Nyundu, ailed for forgery, corruption

Kenneth Nyundu, former Director-General of the Water Resources Management Authority (WARMA), has been sentenced to two years in prison for corruption-related offenses.

Nyundu was convicted by the Lusaka Magistrates’ Court on three counts: forgery, uttering a false document, and obtaining pecuniary advantage by false pretenses.

The court sentenced him to six months each for the first two counts and 12 months for obtaining K709,366.92 through fraudulent means.

The sentences will run consecutively.

The court established that Nyundu had forged his employment contract to include a “net of tax” clause, allowing him to unlawfully earn housing allowance exempt from tax.

This altered contract enabled him to obtain the pecuniary advantage of K709,366.92.

Magistrate Anna Holland ruled that the prosecution had proven beyond reasonable doubt that Nyundu committed the offenses.

She noted that the forged contract exclusively benefited Nyundu, making it evident that he was responsible for the alterations.

The fraud was uncovered after Joe Kalusa, Permanent Secretary of the Ministry of Water Development and Sanitation, noticed discrepancies in Nyundu’s employment contract during a review of executive officers’ documents.

An audit revealed Nyundu’s fraudulent housing allowance claims and his failure to make the required 30% payment for a vehicle despite receiving a vehicle allowance.

Nyundu maintained that his contract was authentic, but the prosecution presented evidence proving otherwise.

In delivering the verdict, Magistrate Holland condemned Nyundu’s actions, emphasizing that they amounted to forgery, uttering a false document, and obtaining pecuniary advantage by false pretenses.
