The matter in which Juldan Motors Limited proprietor, July Danobo, sued his son over the ownership of 32 luxury buses has taken a dramatic twist, with the son countersuing the father and demanding K7 million for loss of business.

In his defence and counterclaim filed in the Lusaka High Court, Raymond Danobo, submitted that the buses in question were a gift from his father in consideration of natural love and affection as his son.
Raymond denied commencing any change of ownership of the property and stated that once motor vehicles are gifted, they cannot be taken away by the donor.
“The defendant shall avail that at no time did he ever initiate a process to transfer the vehicles to any person at all. The defendant shall argue that if at all such process was commenced, it was not done by the defendant but by other person who acted without the defendant’s authority as the registered owner, in terms of the provisions of the road traffic act no 13 of 2002,” he contended.
He stated that from May 2021 to date, he has made an estimated loss of K100,000 per day for the business owing to the squabbles between him and the father.
Raymond demanded that his father and the company render an account on how the buses have been used, as they are business chattels.
This is a matter in which Danobo sued Raymond on allegations that he had refused to change ownership of the 32 buses from his name to Juldan Motors Limited.
He stated that his son was a former shareholder in the company.
Danobo explained that between November 2013 and December 2021, Juldan Motors and Raymond entered into an agreement, whereby he was to hold a number of motor vehicles and other properties in trust on behalf of the company.
He said he in fact assisted in purchasing the said buses under a contract of supply held at Juldan with Hazida Motors limited.
“Documentation including at Road and Safety Agency (RTSA) and Police clearance reports prove and show that the defendant around December 2021 commenced a process in which he intimated by himself to transfer 30 buses, four truck horses and two trailers at (RTSA) to Juldan motors,” he said.
Danobo, however, stated that his son suddenly changed his mind and refused to complete the process.
He said the son’s decision not to transfer the ownership of the buses in question to Juldan Motors had detrimental effects on the general operations of the company and would worsen injurious effect on the general revenue.
Danobo wants the High Court to order Raymond to change ownership of the 32 luxury buses to Juldan Motors Limited.
He is also seeking damages for loss of businesses and any other consequential relief the court may deem fit under the circumstances.
