Court of appeal halts Copperbelt Energy’s seizure of KCM assets over $29.6 million debt

The Court of Appeal has intervened in the long-standing dispute between Konkola Copper Mines (KCM) and Copperbelt Energy Corporation (CEC), staying the writ of execution that allowed CEC to seize KCM’s assets to recover a K11.8 million debt.

On March 17, 2025, CEC obtained a writ of Fieri Facias from the Lusaka High Court, directing the Sheriff of Zambia to seize KCM’s properties.
However, the Court of Appeal has now halted further execution of the writ, pending the determination of CEC’s appeal.

The appeal concerns a debt of $29.6 million, which CEC claims KCM owes for unpaid energy bills.
The Lusaka High Court had previously ordered KCM to settle a part payment of $11.8 million by December 12, 2024.

KCM had attempted to overturn the ruling, arguing that new evidence had emerged and that CEC was taking conflicting legal positions.
However, the High Court Judge Charles Kafunda dismissed KCM’s application for review, leading to the appeal.

Interparte hearing is set to be heard on April 9, 2025.
