Court awards Malanji K60,000 in rental dispute case

The Lusaka High Court has ordered Joseph Malanji’s tenant, Zulu, to pay rental arrears amounting to K60,000.

High Court Judge Sharon Newa delivered the ruling on August 29, 2024, giving Zulu an ultimatum to vacate house No. 629 in Silverest by November 29 or face legal consequences.

The court’s verdict followed Malanji’s lawsuit against Zulu, whom he accused of defaulting on rental payments since January 2022.

Malanji argued that the non-payment had caused him “significant financial losses,” prompting the legal action.

Judge Newa ruled in Malanji’s favor, stating, “The tenant was required to clear the outstanding rental arrears amounting to K60,000 and continue paying the current rent of K5,000 per month until he vacates the premises.”

The judge emphasized the importance of adhering to the rental agreement, adding, “Failure to comply with this order will result in additional legal action.”

The ruling also noted that interest would accrue on the outstanding amount, increasing Zulu’s debt unless payments are made promptly.

Zulu has been ordered to settle the arrears by the set deadline or risk further financial penalties.

Malanji expressed satisfaction with the court’s decision, saying,” Justice has been served.

“This ruling not only addresses my financial losses but also reinforces the principle that rental agreements must be respected,” he added.

Zulu’s legal team indicated that they were considering an appeal but declined to comment further on the court’s decision.

Judge Newa concluded the ruling by awarding costs to Malanji, while also granting both parties the option to appeal the decision.

Malanji’s victory in the rental dispute marks a significant legal win, as the court upheld his claims and reinforced the consequences of failing to honor rental agreements.
