Constitutional Court judges testify in gross misconduct case against Judges Sitali, Mulenga and Mulonda

Constitutional Court President, Justice Margaret Munalula, and retired Constitutional Court Judge, Hildah Chibomba, appeared on Wednesday before the Judicial Complaints Commission (JCC).

They were summoned to testify in a disciplinary case involving suspended Constitutional Court judges, Annie Sitali, Mugeni Mulenga, and Palan Mulonda.

The hearing was conducted in camera, following a complaint by Lusaka resident, Moses Kalonde, who alleged gross misconduct by the judges in their handling of the 2016 election petition.

In 2016, the three suspended judges had dismissed President Hakainde Hichilema’s petition challenging the election victory of former President Edgar Lungu.

However, Justices Munalula and Chibomba dissented from the majority ruling.

Justice Munalula attended the morning session of the hearing, while Justice Chibomba was scheduled to testify in the afternoon.

On September 23, 2024, President Hichilema suspended Judges Sitali, Mulenga, and Mulonda after the JCC found a prima facie case of misconduct against them.
