Chitambo MP, Mutale, sued for K3.7 million over fatal accident

Chitambo Member of Parliament, Remember Mutale, is facing a K3.7 million lawsuit for allegedly causing the death of a 25-year-old driver, Joseph Kaumba Yikona, through reckless driving.

Elizabeth Kanoka, acting as the administrator of Yikona’s estate, has filed the suit in the Lusaka High Court, seeking damages for the deceased’s dependents.

According to court documents, the accident occurred on March 29, 2024, between 22:30 and 23:30 hours at the intersection of Katima Mulilo Road and the road leading to Cross Roads Lodge.

Kanoka alleged that Mutale fled the scene after the crash, leaving Yikona critically injured.

A good Samaritan later rushed him to the hospital, where he succumbed to his injuries.

The lawsuit cites a police report that attributed the accident to the MP’s careless driving.

The legal action highlights the impact of Yikona’s death on his family, particularly his two young children, aged four years and three months at the time.

As a driver and mechanic, Yikona reportedly earned K2,710 per month, and his sudden death has left his dependents without financial support.

Through Nchito & Nchito Advocates, Kanoka is demanding K3,743,296 in damages under the Fatal Accidents Act, compensation under the Law Reform (Miscellaneous Provisions) Act, interest on the claimed amounts, and legal costs.
