ANTRAA Coal Zambia Limited, directed by former Defence Minister, Richwell Siamunene, has taken legal action against the Attorney-General over the cancellation of its large mining licence.
Prime Quest Minerals Limited and Sino Great Logistics, potential buyers of the licence, are also respondents in the matter.
Siamunene, as the applicant, seeks a judicial review to challenge the decision of the Director of the Mining Cadastre Department to cancel the licence.
He requested an order to quash the decision, declare the cancellation illegal and null and prohibit the respondents from taking possession of the mine.
Damages for shame, stress, pain, anguish, and embarrassment are also sought.
In 2016, ANTRAA received a large-scale mining licence No. 17611-HQ-LML valid for 25 years, but it was abruptly cancelled on April 2, 2024, a decision Siamunene deems illegal.
According to him, efforts to appeal the cancellation to the Ministry of Mines and Minerals Development have been unsuccessful.
The case is connected to an ongoing legal dispute, Mutimbi Real Estate Limited vs. EMCO Resources B.V. Netherlands, ANTRAA Coal Zambia Limited, and EMCO Holdings Limited, which is awaiting a verdict in November 2024.
Siamunene contends that the respondents’ actions are undermining the legal process and will ultimately render the upcoming judgment meaningless.
