ACC seeks forfeiture of trucks traced to former PF cadre’s company, Altitude Properties

The Anti-Corruption Commission (ACC) is pushing for the forfeiture of two trucks seized from Altitude Properties, a company owned by Francis Muchemwa, a former PF Intercity cadre.

The ACC alleged that the trucks were purchased with proceeds from criminal activity.

Massbreed Investments claimed ownership of one of the trucks, arguing that the ACC’s seizure was based on incorrect ownership claims.

The company contended that its contract with Altitude Properties was a hire-purchase agreement and that the US$62,000 was a down payment, not the full payment, for the truck.

However, ACC investigations officer, Claudia Chibiliti, disputed Massbreed’s claims.

In an affidavit filed in the Economic and Financial Crimes Court, Chibiliti argued that the transaction was a sale, not a hire-purchase agreement and that the $62,000 paid by Altitude Properties was the full cost of one truck.

She contested Massbreed’s claim that only $26,656.74 was paid, stating that this was part of a total payment of $88,656 for two trucks.

Chibiliti stated that since one truck was fully paid for, forfeiting the trucks to the State would not prejudice Massbreed.

The ACC submitted that Muchemwa’s legitimate source of income amounted to K4,934,912, significantly below the value of unexplained and suspected proceeds of crime, which amounted to K7,234,824.

Muchemwa had been taken to court along with Altitude Properties Limited, Friltech Networks Zambia Limited, and Massbreed Investments Zambia Limited.
