The Food Reserve Agency (FRA) has launched a counterclaim against Imaber General Trading Limited, accusing the company of breaching multiple contracts and demanding damages.
The legal standoff began when Imaber sued FRA for allegedly failing to deliver 811.13 metric tons of Grade ‘A’ Zambian white maize worth over K3.2 million, despite receiving full payment.
The company claimed FRA violated four contracts, resulting in a liability of more than K4 million.
In its defense, FRA asserted that all contractual obligations were met, noting that Imaber signed off on crop sales collections and took full possession of the maize through authorized delivery orders.
FRA further accused Imaber and its associates of engaging in fraudulent practices, including falsifying documents, altering delivery records, and using unauthorized letters to access maize stocks.
The agency argued that these actions breached at least two contracts, alleging that Imaber manipulated delivery data to cover unauthorized maize collections, failed to report accurately, and violated integrity clauses.
FRA maintains that Imaber has not suffered any financial loss and is not entitled to compensation. Instead, the agency seeks damages for breaches of Contracts Four and Six, along with interest on the disputed amounts.
The matter is now before the Lusaka High Court.
