Diamond TV seeks default judgment in defamation case against socialist, Mwanza

0

Diamond Television (trading as Mobitel Company) has taken legal action against socialite Mutale Mwanza, seeking a default judgment in a defamation lawsuit after she failed to respond to court proceedings.

The media house sued Mwanza over accusations that she falsely labelled its Personality of the Year Awards (POTYAS) as fraudulent and “hosted by hoes.”

Diamond TV argued that these statements harmed its reputation and caused distress to its staff.

As part of the lawsuit, the company is demanding a court declaration that Mwanza’s remarks were defamatory, as well as compensation for reputational harm, emotional distress, and financial losses.

The media house is also seeking an injunction to prevent further defamatory statements from Mwanza.

Court documents revealed the case was filed on November 21, 2024.

Although Mwanza was served with legal documents on December 8, 2024, she had failed to respond or enter a defense within the required 14-day period.

Legal representatives for Diamond TV, Kang’ombe and Associates, argued that Mwanza’s failure to respond justifies the court granting a default judgment in favor of the media company.
