Matero MP, Sampa, seeks court summons for Mines Minister over Mopani-Delta deal

In a fresh twist to the ongoing legal battle over the controversial transfer of 51 percent Mopani Copper Mines shares to Delta Mining Limited, Miles Sampa has asked the Constitutional Court to summon Mines Minister, Paul Kabuswe, and two others to testify in the case.

Sampa,the Matero Member of Parliament, wants Kabuswe, his Permanent Secretary Dr. Hapenga Kabeta, and ZCCM-IH Chief Executive Officer, Dr. Ndoba Vubetti, to testify before the Constitutional Court regarding the controversial transfer of 51% shares to Delta Mining Limited.

The subpoenas, filed on February 25 by Sampa, demand that the trio provide critical evidence, shedding light on the details of the transaction.

Sampa, in his court application, is also seeking an order for them to produce a comprehensive record of the deal, including all agreements, government reports, feasibility studies, meeting minutes, financial documents, and official communications tied to the transaction.

Sampa contended that the Mopani-Delta deal, facilitated by ZCCM Investment Holdings, was not merely a “subscription” of shares, as claimed by the Attorney General, but a full-fledged sale that required parliamentary approval.
In a supporting affidavit, Sampa insisted that without full disclosure of documents and testimonies from key officials, the court would unable to fairly and justly determine the case.”

In order to effectively and justly determine the issues in contention before court, it is imperative that all relevant documents relating to the sale and transfer of shares from ZCCM to Delta Mining Limited be placed before court,” he argued.

The matter came up before Judge Mwandenga on March 3, where the Attorney General’s Chambers, represented by Acting Deputy Chief State Advocate C. Mulonda, requested time to respond to the subpoena application.

The judge granted the state’s request and set tMarch 6 for Attorney General to file a response and March 10 for Sampa to file a reply while the application for summons would be heard March 11,2025.

An extension for filing the record of proceedings was granted until March 4, with a status conference scheduled for March 5.
