Lusambo’s bail request thrown out, as court reportedly finds no convincing grounds, exceptional circumstances

Former Kabushi Member of Parliament, Bowman Lusambo, has suffered another legal setback after the Economic and Financial Crimes Court denied his request for bail pending appeal.

Lusambo, currently serving a four-year sentence for corruption, sought temporary release, citing his role as the sole provider for his family and his wife’s medical condition. However, the court found his arguments unconvincing.

A panel of judges—Anne Malata-Ononuju, Ian Mabbolobbolo, and Vincent Siloka—ruled that Lusambo failed to demonstrate exceptional circumstances warranting bail.

His legal team argued that he was not a flight risk, had adhered to previous bail conditions, and that his appeal raised significant legal questions.

The prosecution countered that compliance with bail terms and family responsibilities did not justify his release.

The court also dismissed concerns about potential delays in the appeal process, noting that the EFCC follows a fast-track system, ensuring cases are concluded within five months.

Furthermore, the judges ruled that Lusambo’s appeal had slim prospects of success, emphasizing that any novel legal arguments should be addressed by the Court of Appeal, not at the bail stage.
