Social media blogger, Kapwepwe, to face trial for alleged hate speech, court rules

Livingstone Magistrates’ Court has found social media blogger Francis Kapwepwe, popularly known as “Why Me,” with a case to answer in connection with alleged hate speech targeting Tonga-speaking people.

Kapwepwe, who has been in detention for over six months, appeared before Magistrate Thabita Muleya on Friday.

He faces charges of hate speech and expressing contempt for persons based on race, tribe, or place of origin, under Section 70(1) of the Penal Code Chapter 87 and Section 65 of the Cyber Security and Cyber Crimes Act.

Magistrate Muleya ruled that the prosecution had presented sufficient evidence to establish a prima facie case against Kapwepwe.

The accused is expected to open his defense on January 15, 2025, and has indicated that he will not call witnesses.

The charges stem from allegations that Kapwepwe published hate speech on Facebook between March 29 and April 6, 2024, in Livingstone.

The offensive content was reportedly shared on multiple online platforms, further spreading the material.
