Matero Member of Parliament and Patriotic Front (PF) faction leader, Miles Sampa, has petitioned the High Court to dismiss an ex-parte stay order that temporarily blocked his decisions to remove Morgan Ng’ona as PF Secretary-General and dissolve the party’s Central Committee.
Sampa argued that the stay order, dated July 4, 2024, was obstructing the effective functioning of the PF and questioned its legal basis.
In his affidavit, Sampa described the application for the stay order as “procedurally flawed” and without merit.
He contended that such orders were typically issued to suspend judicial or tribunal decisions, which he argued did not apply in this case.
“The stay order, by its legal nature, is intended to temporarily suspend a judgment, ruling, or decision rendered by a judicial or tribunal body pending appeal or review. It is highly irregular for the plaintiff to seek a stay order in the absence of any court ruling or judgment,” he stated.

Sampa further claimed that the order disrupted the party’s governance by stalling critical decisions necessary to stabilise its internal operations.
He accused Ng’ona of using the legal process to delay proceedings and retain influence within the party despite his removal.
He urged the court to lift the stay order, describing it as procedurally irregular and detrimental to the PF’s functionality.
