Former Ministry of Defence Permanent Secretary, Stardy Mwale, raised eyebrows by arriving at the Lusaka Magistrates’ Court with an IV cannula in his arm, reportedly in fear of a bench warrant issuance.
Chief Resident Magistrate Davies Chibwili adjourned the proceedings on humanitarian grounds after Mwale reported feeling dizzy, but refused to vacate an earlier order for an explanation from medical personnel who issued Mwale’s sick note.
The note, dated May and November 4, bore stamps from multiple hospitals, raising questions as it conflicted with Mwale’s claim of treatment at Konkola Mine Hospital.
The bench warrant had been warned of by Magistrate Chibwili on Tuesday if Mwale failed to appear.
Mwale faces charges for allegedly failing to comply with procurement laws in the acquisition of a presidential jet and one count of corrupt acquisition of public property.

In court, Mwale cited his health as the reason for missing a prior session and claimed he was briefly admitted to Konkola Hospital.
However, Magistrate Chibwili found inconsistencies, stating, “The information doesn’t tally. I’ll address this fully after seeing the person who issued the note.”
Magistrate Chibwili also noted the absence of Mwale’s two lawyers, Leon Lemba and Siwila, without explanation.
Although Mwale requested an adjournment for legal representation, State prosecutor Daniel Ngwira raised no objections, acknowledging Mwale’s unwellness.
The case was adjourned to November 11, 19, and 22 for further defense proceedings, with the order for a medical explanation on the sick note still in effect.
