Group seeks to join Constitutional Court case on decriminalising homosexuality

Heart of Mercy Zambia, a non-governmental organization, has applied to join the Constitutional Court case seeking to decriminalise homosexuality.

The organization, represented by its Secretary-General, Miza Phiri, a lawyer, seeks to participate as an interested party.

In the affidavit, Phiri stated that Heart of Mercy Zambia was a registered society under the Societies Act with over 20 years of existence.

It said the organization aims to protect the vulnerable and promote decent morals in society through various avenues, including religion.

With members in Lusaka, Central, Copperbelt and Northern provinces, the organization added that it was interested in the outcome of the petition, which may impact society and its members.

The petition, filed by Isaac Mwanza and the Zambian Civil Liberties Union (ZCLU), challenges the constitutionality of Section 155 of the Penal Code, which criminalizes sexual acts “against the order of nature.”

The petitioners argue that the section is discriminatory, vague and ambiguous, infringing on fundamental human rights, including dignity, privacy, and equality.
