Relief for nine expelled PF lawmakers, as Lusaka High Court halts declaration of seats vacant

The Lusaka High Court has intervened to halt Deputy Speaker Moses Moyo’s decision to declare the seats of nine Patriotic Front (PF) Members of Parliament vacant.

This development followed the MPs being granted leave to initiate judicial review proceedings, challenging what they term an illegal and irrational declaration.

Recently, the Deputy Speaker of the National Assembly, Moses Moyo, declared nine seats belonging to Members of Parliament from the Patriotic Front (PF) vacant.

This decision sparked controversy as the MPs contested that they had not been expelled from their party, a prerequisite under parliamentary rules for such declarations.

Notable figures among the MPs contesting the decision included Mutotwe Kafwaya and Christopher Kang’ombe.

They argued that they had not been expelled by their party, asserting that Deputy Speaker Moyo’s declaration violated parliamentary protocols and the National Assembly’s jurisdiction.

The MPs seek court declarations to nullify their alleged expulsion, declare the decision to vacate their seats illegal and irrational, and annul Moyo’s decision through an order of certiorari.

They emphasize that the PF party has not expelled them, which they claim has been communicated to the Speaker’s office, alleging a legal blunder by Moyo in not adhering to parliamentary Standing Orders.

This case is currently under consideration by the Constitutional Court.
