Former Roman Catholic Archbishop, Emmanuel Milingo, and his wife, Maria Sung, have been dragged to the Lusaka High Court over the tenancy of Chillux Sports Pub located in Chilanga, with the litigant claiming to be the lawful tenant of the property.
Luchards Investments Limited trading as Chillux Sports Pub sued Milingo, his wife and Eric Fulaza, accusing them of attempting to evict them from the property.
Luchards Investments Ltd Director, Lucky Mulusa, wants the High Court to issue a restraining order against the trio, alleging that there was a real risk that they may dissipate the property before the conclusion of the matter.
Luchards Investments and the landlord known as Zambia Helpers Society run by Milingo and his wife, entered into a tenancy agreement in 2017.
Mulusa said the tenancy agreement as proposed by the then landlord, Zambia Helpers Society, provided for 12 months notice if not to be renewed or if to be terminated by either party.
He said with permission from the Milingo, they built a car wash to be owned by Luchards Investments Ltd.
“That during the subsisting period, there was an on-going legal wrangle in the High Court of Zambia under cause 2018/hp/1455 between Zambia Helpers Society and Archbishop Milingo over the ownership of a part of the land as it was alleged to have been donated and owned by Zambia Helpers Society the second defendant,” he said.
Mulusa stated that the High Court pronounced itself also on the land not paid for by Milingo and thus appealed to the Court of Appeal.
“The court pronounced itself on the management of the properties rented by Zambia Helpers Society which is still the legal manager of the properties on the land in contention,” he said.
He added that on January 4,2024, Luchards Investments was called to a meeting attended by Mrs Milingo where it was agreed that rental payments to Zambia Helpers Society be made through Wellington Musowoya on MTN number.
“That on January 12 ,2024, the rental payment was returned to the plaintiff with the explanation that Luchards Investments Ltd had no tenancy agreement with Mrs Milingo who Luchards Investments Ltd came to learn was not Luchard’s landlord as earlier misrepresented.
“That the proprietor of Lito’s mini Mart, one Eric Flazer locked out Luchards Investments Ltd, claiming to be the new landlord,” he said.
Luchards Investments is, therefore, seeking a declaration that they are the lawful tenant.
