Former Disaster Management and Mitigation Unit (DMMU) boss, Chanda Kabwe, has countersued the Lusaka businesswoman m, and he is seeking an order that she hands over the white book and facilitates smooth change of ownership process of Volvo Light truck.
Catherine Kunda last month filed a suit against Kabwe in the Lusaka High Court, alleging that he had refused to settle the K110,000, despite several reminders.
The litigant stated that the former senior government official agreed to buy her light truck motor registration No. AHB 73892M at a total cost of K330,000 in December, 2021, but failed to fully settle the amount.
Kunda is demanding immediate return of her vehicle in its original state and settle the balance.
But Kabwe had filed a defence and counter claim against the defendant that he only owes Kunda K15,000.
He stated that the vehicle in question has been problematic from the day it was brought and it was currently parked after spending resources on it.
“That the correct position is that the defendant in order to help out the plaintiff who had fallen into hard times, entered into an oral contract to sell and to buy a Volvo truck reg no. AHB 7389ZM at a total cost of K300,000 and not K330,000 being alleged.
“And paid a total of $10,000 at a rate of K18.5 to $1 cash in and equivalent to a total of K185,000 in December 2021 and not the K210,000 being alleged and leaving a balance of K115,000 and not the K210,000 being alleged,” he stated.
He said in March,2022, he paid a further K100,000 to the plaintiff as agreed, leaving a balance of K15,000 and not the K110,000 being alleged by Kunda.
“The defendant maintains that he has discharged his obligation to the said oral contract and only remains with balance of K15,000 to be paid upon the plaintiff handing over the white book and completing the motor vehicle change of ownership formalities,” he contended.
Chanda is, therefore, seeking a declaration that he had discharged his obligation under the said oral contract.
