The Solwezi Subordinate Court has convicted and sentenced former National Pension Scheme Authority (NAPSA) Accounts Clerk, Stark Simbaya, to two years imprisonment with hard labour for fraud involving over K2 million.
Magistrate Davies Chibwili found Simbaya, 48, of flat no. 5 Urban Area in Solwezi, guilty of Fraudulent False Accounting, says the Anti-Corruption Commission (ACC).
ACC Head of Corporate Communications, Timothy Moono, revealed this in a statement issued in Lusaka on Tuesday.
Moono said Simbaya was also found of Uttering of False Documents contrary to Sections 326 and 352 of the Penal Chapter 87 of the Laws of Zambia.
“Simbaya was arrested by the ACC in 2017 and charged with thirty-one (31) counts of Fraudulent False Accounting and three (3) counts of Uttering of False Documents,” he said.
Moono stated that the facts of the offence were that between June, 1, 2016 and May, 31, 2017, Simbaya made Fraudulent False Accounting.
He said this was through purporting that three companies namely Freca Mining, Buildcon and Silondwa Engineering Works Limited had paid the NAPSA monthly contributions when in fact not.
“Simbaya is further alleged to have knowingly and Fraudulently Uttered False documents namely NASPA Employer Statements in the name of the said companies,” Moono noted.
He added that in passing the sentence, Magistrate Chibwili also ordered and directed that the sentence was to run concurrently on each count with effect from December, 18, 2023.
