The United Party for National Development (UPND) National Chairperson for Special Duties, William Banda, has filed a K3 million lawsuit against the State, alleging unlawful imprisonment.
In a statement of claim filed in the Lusaka High Court , Tuesday, Banda claimed he was unlawfully imprisoned in 2019 without any probable cause, simply because he belonged to then opposition UPND party.

The Attorney-General was cited as the defendant in the matter.
Banda said he was arrested at then opposition UPND leader, Hakainde Hichilema’s house in New Kasama on April 10,2019.
He and 10 others were accused of obstructing police officers who went to arrest Mr Hichilema in relation to treason charges.
He stated that he was tortured by Police whose intent was to induce a confession that he was with the President in Mongu.
Banda stated that at Emmasdale Police Station, he could not have access to his relatives or advocates.
He alleged to have spent 14 days in police cells and was tortured by the police.
“The defendant’s agents threatened the plaintiff with death and did assault the plaint by use of excessive force, torture, striking his body with short buttons, iron rod, pulling and twisting the plaintiff’s ears thereby inflicting pain and injuries to the plaintiff,” he said.
Banda is claiming damages for mental anguish, turmoil and distress suffered as a result of the unlawful imprisonment.
He is also demanding damages for assault occassioned by the police officers as well as dmages for defamation of character.
