The Anti-Corruption Commission, (ACC) has arrested Choma Town Clerk, Davies Musenge, for corrupt practices involving K953, 887.50.
ACC Head of Corporate Communications, Timothy Moono, said Musenge had been arrested on three counts of fillful failure to comply with applicable law and procedure.
Moono in a statement issued in Lusaka on Saturday said this was contrary to Section 34(2)(b) as read with Section 41 of the Anti–Corruption Act No. 3 of 2012.
He said the offences were alleged to have been committed when Musenge served as Town Clerk for Chipata Municipal Council.
“Details of the offence in count one are that, between January, 1, 2014 and August, 31, 2014 at Chipata, Musenge being Town Clerk at Chipata Municipal Council willfully failed to follow applicable procedure and guidelines,” Moono said.
He said this was in the manner he executed a contract tender No. PPC/EP/5/2013 dated August, 16, 2014 between Chipata Municipal Council and Micro-Pro Innovations Limited for the supply and delivery of 2 Skip Trucks and 11 bins.
Moono said this was done without the approval of the Attorney-General and without obtaining Performance Security for the said contract as provided for under the Public Procurement Act No. 12 of 2018.
“In count two, details are that between January, 1, 2014 and November, 30, 2014 at Chipata, Musenge being the Town Clerk at Chipata Municipal Council, willfully failed to follow applicable procedure and guidelines,” he said.
Moono said this was in the manner he executed a contract tender No. PPC/EP/10/2014 dated October, 28, 2014 between Chipata Municipal Council and Marygold Investments Limited.
He said this was for the supply and delivery of one drilling rig with drill accessories and portable air compressor at a contract sum of K1,127,850.
“This was done without the approval of the Attorney General and without obtaining Performance Security for the said contract as provided for under the Public Procurement Act No. 12 of 2018,” Mono said.
He said details in count three were that Davies Musenge and Ford Tembo, between 1st January, 2014 and 31st December 2015 at Chipata, being a public officers namely Town Clerk at Chipata Municipal Council and Chairperson for Chipangali Constituency in Chipata, respectively, willfully failed to follow applicable procedure and guidelines.
Moono said this was in the manner they authorized an advance payment to Marygold Investments Limited totaling K953, 887.50 translating to 75 percent of the contract sum without seeking authority from the Zambia Public Procurement Authority (ZPPA) as prescribed by law.
“Musenge has been released on Bond and will appear in court soon. In another development, the Commission has also arrested a Choma businessman for theft of 16 FISP Packs of groundnuts valued at K17,841.71,” he said.

Also, Moono said Ezra Mabbalani, of Sibanyati Village in Choma had been arrested on one count of theft by agent contrary to Section 280(b) as read with Section 265 of the Penal Code Chapter 87 of the laws of Zambia.
He said details of the offence were that, between January, 1, 2023 and January, 31, 2023, Ezra Mabbalani did steal the said 16 packs of groundnut seed, property of Notuceya Women’s Club which was entrusted to him by Kamano Seed Company Limited.
Moono said Mabbalani had been released on bond and would appear in court soon.
