Opposition lawmakers file motion to seek Speaker Mutti’s impeachment

Nkana Independent Member of Parliament, Binwell Mpundu, has notified the office of the Clerk of the National Assembly of a motion to impeach speaker of the National Assembly, Nelly Mutti, citing a number of parliamentary standing orders breaches.

“I Binwell Mpundu seconded by Lunte Member of Parliament wish to move a motion for the impeachment of the speaker of the National Assembly, Madam Nelly Mutti, pursuant to article 83 of the constitution as read together with order 8 of the standing orders,” the impeachment motion notification read in part.

The notice for the impeachment which date stamp indicated Friday, November 3, 2023 as seen by Zambia Monitor, has been backed and signed by 39 law makers, mainly from the Patriotic Front (PF ) and a few independent members.

Members of Parliament have accused Mutti of committing gross misconduct and violations of the Zambian constitution.

Mpundu alleged that the Speaker was on November 1, 2023, during the proceedings grossly misconducted herself when she curtailed Kamfinsa lawmaker, Christopher Kang’ombe, from exercising his freedom of expression and debate in the house.

Other allegations were that Mutti on November 1, 2023, grossly misconducted herself and violated article 74(2) of the constitution of Zambia when she announced Robert Chabinga, Mafinga MP as leader of the opposition based on a letter from a Morgan Ng’ona while ignoring correspondence from the PF indicating that there was no change of the leadership of the holder of the opposition, Brian Mundubile.

The third ground for the impeachment motion was that the speaker violated article 72(2)(E) of the constitution when she failed to declare the Matero seat vacant when she was fully aware of the occupants’ expulsion from the PF.

The final ground was that she violated article 74 (2) when she changed the leader of opposition but refused to expel the Matero lawmaker pursuant to article 72(2)(E) of the constitution of Zambia.

Zambians wait to see if the motion would be tabled in parliament and its chances of succeeding given that the removal of the speaker would require a two third majority which the opposition may not be able to mobilize.
