Former Cabinet Minister, Stephen Kampyongo’s wife, Wanziya, has sued her tenants in the Lusaka High Court for non-payment of rentals amounting to over K140,000.
Wanziya Chirwa submitted to court that Adrian Ndhlovu and Marlon Banda had neglected to pay the rent as per the agreed tenancy agreements and now owe K86,000 and K56,000, respectively.
Chirwa wants the duo to vacate her houses on plot no 3 in Lusaka’s Foxdale area.
The applicant claimed a tenancy agreement dated March 1, 2021, with Ndhlovu and the agreed rental price was K7,000 per month.
Chirwa stated the said agreement was renewed in 2022 on the same conditions.
“That in March 2022, the respondent became illusive and refused or neglected to pay the rent as per the agreed tenancy agreement. That several efforts have been made to recover the said rental arrears,” she said.
Chirwa said Ndhlovu later paid a K25,000 in February towards the outstanding arrears of K70,000 as at that time.
She said despite the respondent pledging to pay off the outstanding balance in 49 days,he had refused or neglected to do so bringing the rental arrears as at June,this month to K86,000.
In another originating notice of motion, Chirwa explained that Banda was also a problematic tenant who had neglected to settle K56,000.
She submitted that by a tenancy agreement dated June 24, 2021, Banda agreed to rent the house for a year.
“That on June 24, 2022, the tenancy agreement was renewed under the same conditions. That despite several reminders and follow ups, the respondent neglected, refused and failed to pay me and has been owing me rent arrears from November 2022 to June 2023 amounting to k56,000,” she submitted.
Chirwa is seeking recovery of the rental arrears and leave for her to levy distress for the same pursuant to section 24 and 14 of the rent act.
