Mwanawasa family suffers another setback, as court orders recovery of over $60,000 owed Belgian firm

Levy Mwanawasa and Company’s goods and chattels are to be confiscated by baliffs after a writ of fieri facias was re-issued in the Lusaka High Court to recover more than US$60,000 owed to a Belgium based company.

This follows the failure by the Levy Mwanawasa and Company, a law firm, to pay a sum of US$58,891.00 and US$2,000 to NV Alterra.

“You are hereby commanded in the President’s name that of the goods and chattels of Levy Mwanawasa and Company (sued as a firm) you cause to be made the sum of USD58,891.00 and USD2,000 as damages from May, 2020 to date also interests thereon from the date of writ of summons which said sum of money and interest were lately before the High Court for Zambia in a certain action wherein NV Alterra is the plaintiff and Levy Mwanawasa and Company is the defendant by a court order dated 13th December,2021.

“The court orders to be paid by the said Levy Mwanawasa and Company the sum of USD58,891.00 and USD2,000 as damages from May ,2020 to date also interests thereon at the current bank rate per annum from the date of writ of summons an costs,” read the Fi Fa.

NV Alterra had sued the law firm and its managing partner, former First Lady, Maureen Mwanawasa, for failure to transfer US$58,891.00 received on its behalf.

The money was paid to Levy Mwanawasa and Company on behalf of the client (NV Alterra) after the sale of a property, but the law firm failed to remit the said money upon receipt.

The High Court in a ruling of December 13, 2021, delivered by Judge Pixie Yangailo ordered the firm to pay the money plus damages for loss of business.
