Internal wrangling threatens to tear PF apart, as party chieftains battle Sampa in court

The Central Committee, elected Members of Parliament and Office bearers of the Patriotic Front (PF) have ganged up to battle Miles Sampa in Court in a matter he is challenging the party’s alleged abrogation of the Constitution by its failure to hold the extraordinary convention.

In this matter, Sampa, a PF presidential candidate sued the Registrar of Societies and the Attorney General in the Lusaka High Court seeking an order that his party’s failure to hold the extra-ordinary convention breached his rights under the party and Republican Constitution.

Sampa also seeks an order that the Registrar of Societies compels PF to hold an extraordinary general conference, no later than 30 days from the date of the judgement of the matter.

The Matero lawmaker wants a court directive that, in order to save money, the extraordinary conference be held in Lusaka or Kabwe at a location that is conveniently accessible to all participants.

He also wants a ruling declaring the Registrar of Societies in violation of the law for failing to stop the PF constitution from being repealed.

Sampa submitted that the current appointed 80 MCCs are null and void as non of them had a vote cast on them ahead of other over 100 applicants in April 2021 or appointed (only 3 allowed) by a constitutionally authorized person.

He contended that the Registrar of Societies or their appointed non political agent (NGO) should prepare and conduct the PF extra ordinary conference to ensure a free and fair democratic Elections for the party president and new 25 members of the central committee (MCCs).

In a latest development, PF members have filed ex parte summons for an order of joinder to the proceedings contending that the remedies.

The intended defendants include former defence minister Davies Chama, Ng’onga Mukupa, Monica Mwale Mwansa, Mwimba Malama and former home affairs minister Stephen Kampyongo, Anthony Kasandwe and 47 other MPs, party acting president Given Lubinda and 55 other members of the Central Committee.

Lubinda stated in an affidavit in support of the summons that being members of the central committee of PF, they would be affected by the outcome of the matter as the remedies sought by Sampa bordered on the internal operations of the party.

He submitted that joining them to the mater would prevent multiplicity of actions.

“That there will be no prejudice that will be suffered by the parties if the order for joinder is granted by this honourable court.”
